Terms of Service

You must be at least 18 years old and legally capable of entering into contracts. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Tell us immediately at [email protected] about any unauthorized access.

The Service is offered through credit packs and recurring plans. Credits are consumed when you use AI generation, rendering and automation features. Plans renew automatically until cancelled. Prices and tax are shown at checkout in your selected currency. You authorize us to charge your payment method for each renewal.

If we offer a free trial or promotional credits, the terms of that offer prevail over any conflicting provision in these Terms. Promotional credits expire as stated in the offer and cannot be exchanged for cash.

You retain all rights to the URLs, assets, brand materials and prompts you submit ('Your Content'). You grant Tamo Design a worldwide, non-exclusive licence to host, copy, transmit and process Your Content solely to operate and improve the Service for you. You represent that you have all rights necessary to grant this licence and that Your Content does not infringe third-party rights or violate law.

Subject to your compliance with these Terms and payment of fees, you own the outputs the Service generates for you ('Outputs'), to the extent ownership is legally available. Outputs are generated by machine-learning systems and may be similar to outputs produced for other users; we do not guarantee uniqueness or fitness for any particular use. You are responsible for reviewing Outputs before publishing or distributing them.

Your use of the Service is governed by our Acceptable Use Policy, which is incorporated into these Terms. We may suspend or terminate accounts that violate it.

We aim for high availability but do not guarantee uninterrupted service. We may modify, suspend or discontinue features at any time. We will give reasonable notice of material changes that adversely affect paid plans.

The Service is provided 'as is' and 'as available' without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement, to the maximum extent permitted by law.

To the maximum extent permitted by law, Tamo Design's total liability arising out of or in connection with the Service is limited to the amounts you paid us in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data.

These Terms apply for as long as you use the Service. You may stop using the Service at any time. We may suspend or terminate your account for breach, suspected fraud or to comply with law. On termination, your right to use the Service ends; surviving sections include billing, IP, disclaimers and liability.

These Terms are governed by the laws of Poland, excluding its conflict-of-law rules. Disputes will be resolved by the competent courts of Warsaw, Poland, unless mandatory consumer law requires otherwise.
